You don&#8217;t need to be an AI evangelist or know how to code, but every legal professional must understand enough to issue-spot, advise clients on AI risks, and communicate clearly about the technology. Without this baseline literacy, you can&#8217;t even begin to do your legal job effectively in the current environment.</p></li><li><p><strong>There is no &#8220;one ring to rule them all&#8221; in legal AI</strong>. No single AI tool solves every legal problem. Lawyers must understand the difference between generative (probabilistic) AI and deterministic tools, and choose the right tool for the right function. Trying to use a generalist tool for specialized problems leads to poor results and risk.</p></li><li><p><strong>AI is changing the economics of law and billing by the hour is under threat</strong>. In-house counsel at major companies have already stopped paying outside counsel for work AI can do faster and cheaper. Firms that don&#8217;t adapt to alternative fee arrangements (AFAs, subscriptions, flat fees) will lose competitive ground. AI literacy also means understanding the business reality: speed and efficiency are the new currency.</p></li><li><p><strong>Junior lawyers face a structural challenge, but the AI-literate will leapfrog their peers</strong>. Fewer entry-level attorneys are being hired as AI automates the work they&#8217;d traditionally cut their teeth on. However, those who become AI-literate will accelerate their careers, much like tech-savvy lawyers did during the e-discovery era.</p></li><li><p><strong>Your clients are already using AI and it&#8217;s your job to protect them</strong>. Clients are feeding privileged information into open AI systems without understanding the risks, leading to real cases of privilege being waived. As her education brand grew, so did her personal brand as the go-to trademark expert, leading to more client inquiries than she could handle, which she then funneled to her own alumni.</p></li><li><p><strong>Trademarks is an evergreen, jurisdiction-free practice area</strong>. Trademark demand goes up in both booms (more entrepreneurs) and downturns (side hustles, layoffs). It&#8217;s federal, so attorneys and clients can be anywhere. Built-in renewal and maintenance work creates natural repeat client relationships, making it an ideal subscription/flat-fee practice.</p></li><li><p><strong>Think in restaurant margins, not per-transaction losses</strong>. When lawyers worry about flat fees (&#8220;what if a matter takes longer?&#8221;), Sonia reframes it: a restaurant comps one table&#8217;s meal occasionally but still profits overall. Occasional overruns reveal pricing or efficiency gaps to fix &#8212; they&#8217;re not a reason to abandon flat fees.</p></li><li><p><strong>Try on new pricing models experimentally</strong>. Many lawyers feel trapped by hourly billing but don&#8217;t realize they have complete freedom to change their model client-by-client, matter-by-matter. Sonia&#8217;s advice: try flat fees or subscriptions on the next three clients. Treat it like a variable you can test, adjust, or abandon. The biggest obstacle to AFA adoption isn&#8217;t the law firms &#8212; it&#8217;s <em>clients</em> who demand flat fees, then revert to wanting hourly tracking when they don&#8217;t know how to measure value.</p></li><li><p><strong>True flat fees mean no shadow billing</strong>. Justin&#8217;s definition of a real AFA means deleting timekeepers from the system entirely. Internal hourly tracking undermines the model, creates conflicting incentives for associates, and defeats the purpose of value-based billing.</p></li><li><p><strong>AFAs require more upfront planning, not less</strong>. Flat fees force law firms to sit down early, map out a plan, assign LPM resources, and anticipate scope changes. A partner once told Justin he was &#8220;a pain in the ass&#8221; for requiring this but later admitted it made her team better. The business side (legal ops, pricing, finance) needs to own this so lawyers can focus on lawyering.</p></li><li><p><strong>AI creates a value delivery problem, not a savings problem</strong>. Law firms using AI are spending fewer hours but delivering better outcomes. The framing of &#8220;how much money is AI saving us?&#8221; is the wrong question. The right question is: <em>how are you training your lawyers to use AI properly, and what value is being delivered?</em> AI is giving associates their own junior associates and freeing them up for higher-level work.</p></li><li><p><strong>Construction can quote a skyscraper to the nail &#8212; law firms have no excuse</strong>. If a contractor can price a 50-story building down to individual nails, experienced lawyers who&#8217;ve done the same type of matter hundreds of times can price their work.
